General Travel Conditions

  1. A copy of these general conditions shall, upon first request, be provided free of charge by NV METS.
  2. Deviations to these general conditions or parts thereof, shall only be valid if these are explicitly established in a written document, signed by both parties.
  3. The general conditions of the client shall not apply to agreements entered into by NV METS, or thereto preceding negotiations, including issued offers and acceptances, unless these general conditions are explicitly agreed to by NV METS, in writing.
  4. In case of discrepancy between the English and the Dutch text of these general conditions, the Dutch language version shall be binding.
  5. With travel is meant under these conditions, all services provided by NV METS and/or by third parties on behalf of NV METS. As such, the following services are included among others, under the term travel: the tours and trips (one day or multiple days); reservation of hotels, pensions, houses, apartments and such like; booking of flights; booking of rental cars and all other services, in whatever form, provided at present or in future by NV METS or by third parties on behalf of NV METS.
  6. With travelers is meant under these conditions, all those who purchase the services as referred to under article 2, from NV METS.
  7. With client is meant under these conditions, the natural or legal person who purchases a trip for himself or on behalf of one traveler or multiple travelers who can be regarded as a group.
  8. At acceptation of the reservation, the client and/or traveler is accountable for compliance with all his/her obligations arising from the travel agreement. NV METS is also liable to compliance with all its obligations arising from the travel agreement, unless such compliance cannot, in all reasonableness, be claimed from NV METS due to situations of force majeure such as natural disasters, political unrest, suspension of payment or bankruptcy of third parties charged with the execution of the travel arrangement, or parts thereof, and other forms of force majeure.
  9. A written confirmation of the acceptance of the reservation by NV METS and a deposit of minimally 25% of the indebted sum as per the travel agreement, serve as sole proof of the conclusion of the travel agreement for the client and/or traveler. These conditions form an integral part of the travel agreement. The balance of the travel arrangement sum is payable to NV METS at the latest 30 days prior to the departure date, the day of departure not included. Upon failure of timely payment of the balance by the client and/or traveler, NV METS is authorized to annul the reservation and maintain the deposit amount as compensation, subject to the provision under article 9 of these conditions. Administration costs are charged at payments with credit card, cash card and traveler’s check.
  10. The travel arrangement is indicated in the travel program as issued by NV METS to the client and/or traveler, one or the other unless agreed otherwise in writing.
  11. The published sum of the travel arrangement is based on several persons per room, as indicated in the travel agreement. Upon payment of a single surcharge, the traveler’s accommodation is based on one person per room.
  12. Without prejudice to the provisions in these conditions, NV METS reserves the right to change the published sum of the travel arrangement in case this is co-established by the tariffs of services obtained by NV METS from one party or multiple parties, and in case these tariffs are changed by such party/parties. NV METS shall notify the client and/or traveler of this change as soon as possible but at the latest 7 days prior to the departure date. Following, the client and/or traveler has the option to cancel the trip if the change regards an increase higher than 20% of the published travel arrangement sum. Already paid amounts shall be refunded without an interest compensation if NV METS is notified of such cancellation by the client and/or traveler within 3 (three) days, following the notification by NV METS of the change of the travel arrangement sum to the client and/or traveler.
  13. The traveler is compelled to be in possession of all required documents regarding visa, immunizations and vaccinations, upon departure to Suriname and at traveling from Suriname to countries abroad, as well as during all trips. The duration of the travel arrangement is indicated in whole days or whole weeks whereby the days of departure and arrival are regarded as whole days.
  14. For travelers for whom the reservation took place outside Suriname, is meant here with departure, the departure to Suriname.
  15. NV METS is not liable for consequences which may arise from failure to comply with the obligation of aforesaid immunizations and vaccinations and the client and/or traveler indemnifies NV METS in this regard.
  16. At the reservation, the client and/or traveler is compelled to submit a valid passport and/or proof of identity of the traveler(s).
  17. At the latest 10 days prior to the departure, the day of departure not included, the client and/or traveler may submit a written request to NV METS to change the travel program, provided that such is possible and at payment of the surplus costs of the travel arrangement and the related administration costs.
  18. In case of cancellation of a trip by the client or traveler, 21 to 30 days prior to the date of departure, the day of departure not included, a cancellation fee of 25% of the total sum of the travel arrangement, shall be payable. At cancellation, 14 to 20 days prior to the date of departure, 50% of the total sum of the travel arrangement shall be payable, and at cancellation less than 14 days, the full sum of the travel arrangement. At cancellation of tours and travel arrangements to a country abroad, the following applies: 56 to 60 days prior to the date of departure, the day of departure not included, a cancellation fee of 25% of the total sum of the travel arrangement, shall be payable. At cancellation, 46 to 55 days prior to the date of departure, 50% of the total sum of the travel arrangement shall be payable and at cancellation less than 45 days prior to the departure date, the full travel arrangement sum.
    In cases whereby NV METS makes use of the services of third parties, namely airline companies, cruise lines, tour operators, hotels and transport companies, for benefit of the traveler, deviating cancellation terms may apply which may not necessarily be in conformity with the cancellation conditions of NV METS.
  19. NV METS reserves the right to cancel the travel agreement without being held liable for any compensation and without judicial intervention:
    (a). at a definite participation of less than the published/agreed minimum number of travelers;
    (b). in cases of force majeure as referred to under article 8.
  20. NV METS shall notify the client and/or traveler of the cancellation as referred to in article 19, sub (a), as soon as possible, however, at the latest 7 days prior to the date of departure, the day of departure included. NV METS shall notify the client and/or traveler of the cancellation as referred to in article 19, sub (b), as soon as possible.
  21. NV METS is not liable for the consequences arising from any issued photos, folders and other information material regarding the trip or the travel program.
  22. The client and/or traveler is compelled to take on an appropriate travel and accident insurance and cancellation insurance, at his or her own costs.
  23. NV METS may change the travel program in case of cultural or weather conditions or due to safety reasons.
  24. NV METS reserves the right, without being liable to any compensation, to exclude a traveler from the travel arrangement or from further participation therein, if he/she shows serious misbehavior, in whatever way.
  25. NV METS cannot be held liable for any damage or harm arising from limited communication means, transport facilities or medical aid or the adventurous nature of the trip. Please take along any medication or medical supplies for allergies or illnesses you may suffer from.
  26. In case the travel takes place by aircraft, NV METS cannot be held liable for any damage to the traveler due to delays in the air transportation provided by a third party, caused by a case of force majeure. At check-in at the airport and at other border crossing-points, you must show your passport and health documents which should meet the requirements of the immigration authorities. When travelling with minors, please bring along the required documents of parental authority.
  27. In case of a group booking for a travel arrangement, the client is deemed to notify all members of the group of these travel conditions whereby he or she indemnifies NV METS against all damages in this regard.
  28. Colakreek is available for rent. Renters of the facilities for overnight stay should take this into account.
  29. Colakreek has fixed check-in and check-out times. Check-in at an earlier time, if available, is possible at payment of an extra fee.
  30. These general travel conditions cannot be changed by either an employee, intermediary or agent of NV METS and are exclusively governed by the Surinamese law.
  31. Only NV METS can appeal to the absence of this form.
